General Statement

General Statement

NTT DATA Business Solutions AG and its affiliated companies (hereinafter referred to as NTT DATA) are committed to responsible corporate governance within the scope of their business activities in compliance with the provisions of the German Supply Chain Duty of Care Act (hereinafter referred to as “SCDCA”).

As part of risk analyses, NTT DATA examines where particular human rights and environmental risks could exist in its supply chains and in its own business area. The aspects of equal treatment and equal opportunities, freedom of association, a healthy and safe workplace without any kind of harassment or bullying, prohibition of child labor, appropriate wages, prohibition of abuse of security services, protection of the natural basis of life through environmental pollution, violation of a prohibition resulting from the Minamata Convention, violation of the prohibition of environmentally unsound handling of waste containing substances defined in the Stockholm Convention and violation of the prohibition of the import and export of hazardous waste within the meaning of the Basel Convention are also of particular relevance. Appropriate preventive measures are defined on this basis.

In order to meet its legal responsibility under the SCDCA, NTT DATA relies on a variety of appropriate measures based on the results of the risk analyses, including raising awareness among its own employees to comply with legal requirements or conducting audits of suppliers. NTT DATA has also drawn up a code of conduct for its suppliers, which every supplier must agree to comply with when signing a contract.

If violations of human rights and/or environmental obligations are identified within the company by its own employees or by suppliers, or if such a violation is imminent, NTT DATA will decide on appropriate remedial measures to minimize the extent of the violations or to eliminate them. Serious violations of a protected legal position or an environmental obligation may be grounds for terminating existing business relationships, including all associated contractual relationships.

In addition, NTT DATA has set up a complaints office, which makes it possible to report and uncover human rights and environmental risks and any violations of human rights or environmental obligations within the company and in the supply chain. The fulfillment of the due diligence obligations of the SCDCA is continuously documented by NTT DATA and, in accordance with the legal requirements, an annual report on the fulfillment of the due diligence obligations is prepared and made available.

NTT DATA will critically review compliance with the due diligence obligations on a regular basis and make any necessary adjustments.
