NTT DATA Business Solutions (NDBS) software products, programs, material and services are subject to the export control and sanctions laws of different countries. This may include but is not limited to, the laws of Germany, the European Union, and the United States of America.

Destination Restrictions

NDBS software products, programs, material and services are not available for export, reexport, transfer and/or use in the following countries and regions*:

  • Belarus
  • Crimea, and the occupied parts of Donetsk, Luhansk, Kherson and Zaporizhia (Zaporizhzhia) regions of Ukraine
  • Cuba
  • Iran
  • North Korea
  • Russia
  • Syria

Moreover, Products and services from NTT DATA Business Solutions may be subject to specific sanction regimes. Special attention is required to sanctions established by US, EU, Germany and UK. User is responsible to continuously perform due diligence. Further some features in software products may not be available in some defined geographical areas due to country specific legislation, such restrictions are documented in product documentation.

End-User Restrictions

NDBS Software Products, programs or material may not be used, exported, or transferred to countries/regions or cannot be made available to entities or individuals which are prohibited under applicable sanctions laws, including those listed on any applicable sanctioned party lists (e.g., European Union Sanctions List, U.S. Specially Designated National (SDN) lists, U.S. Denied Persons List, BIS Entity List, United Nations Security Council Sanctions). An overview of those countries/region can be found above.
Restricted end-use transactions may require a license, permit or other documentation, including:

  • Military end uses that may entail an arms embargo or similar restrictions;
  • Certain civilian nuclear end uses; or
  • Industry-specific end-use restrictions, such as for certain energy and financial sectors.

All such transactions are subject to enhanced due diligence and licensing decisions are made on a case-by-case basis.

NDBS software and services may not be used for end-uses related to the development, design, manufacture or production of nuclear, chemical or biological weapons („Weapons of Mass Destruction”)
